Council Meeting Minutes, Thursday, September 10, 2009

Meeting called to order by President Rank at 7:00 PM

Roll Call:  Hansen, Kilgus, Kinzel, Pallin, Rank, Siderman, Superintendent Moore, Clerk Spencer

Excused:  Cantrell, Olney

Old Business:  Spring Valley erosion

New Business:  Streetscape Vision, ice machine money, St. Andrews letter

Approval of agenda - Motion by Kinzel, support by Hansen - All Ayes - MOTION CARRIED

Approval of minutes for August 6, 2009 - two corrections made - Motion by Kinzel, support by Siderman to approve minutes with corrections - All Ayes - MOTION CARRIED

Review of bills for August/September 2009 - Motion by Kilgus, support by Kinzel to approve bills - Roll Call:  AYES:  Kinzel, Pallin, Rank, Kilgus, Hansen, Siderman - NAYES - NONE - MOTION CARRIED

Communication to Council:

Request from Ann Richards for a $250.00 donation for a new climbing event for the Fall Fest -Proof of Insurance has been provided - Motion by Siderman, support by Kinzel to donate $250.00 for event - Roll Call:  AYES:  Pallin, Rank, Kilgus, Hansen, Siderman, Kinzel - NAYES - NONE - MOTION CARRIED

Treasurers report reviewed - Motion by Hansen, support by Kilgus to approve the report - All Ayes - MOTION CARRIED

Water/Sewer - Chairman Kilgus: Motion to approve grant money $8741.35 for Sewer Jetter, support by Hansen - Roll Call:  AYES:  Siderman, Kinzel, Pallin, Rank, Kilgus, Hansen - NAYES - NONE - MOTION CARRIED

Leak on Prospect St . - repairs have been completed.

Storm drain has been placed on Clark St. addressing the run off problem.

Law/Finance - Chairperson Hansen:  Charter Franchise Agreement for ten years requesting usage of roads and right of way - Village had agreement in the past and it has expired - Motion by Hansen, support by Kinzel to continue the agreement - All Ayes - MOTION CARRIED

August Financial statement received will prepare sheets for council members to work on 2010 budget - requesting outline of projects for Capital Outlay be delineated.

Building/Grounds - Chairman Siderman:  Water heater has been replaced in Village Office - thanks to Brian and crew for good work on the grounds.

Parks/Rec - Chairman Pallin:  Thanks to Vicki for article on Fair Park in the Grand Traverse newspaper. Trailer Park - good and successful summer season.  Cindy Ullom will manage and clean for the September shoulder season.  Pallin will do a financial statement for the trailer park.  Ice machine in trailer park - there are some tax issues and money was stolen this summer - recommend discontinuing ice sales - motion by Pallin, support by Siderman to discontinue ice sales - All Ayes - MOTION CARRIED

Streets/Sidewalks - Chairman Kinzel:  New construction of sidewalks on Benzie Ct. and Clark St . - Court Pl. and Clark St. should be completed - others are needed -will roll over money from Capital Outlay to next year.  Resident on Spring Valley complained about brightness of street light, Consumers Energy stated it is required because it lights an intersection. Spring Valley erosion plan is in place.

Superintendent Moore:  New Christmas lights are needed - council stated to order them.  Brian will be at class 9/28-30 - all crew to take exam in November.  Need to procure title for Jetter trailer.  Checking for prices on sand and also trucks.  Fire Department determined fire hydrant on Prospect St. is not necessary - remove.  Hydrants will be flushed in October.  John Lawrence is a papa of a baby boy.

Old Business:

Vicki Carpenter - info passed out on surveys received - still gathering data on comments received - all will be included - newsletter to be done in October

Rank - Received legal opinion on paying for re-assessment on Village property - it is allowed. It is the responsibility of the township to assess properties yearly.  Letter from Sheets the assessment wouldn't start till May 2010 - tax recovery would be 2011.  Discussion ensued - Siderman would not support on moral grounds - Kilgus unsure - Kinzel - motion to hire township for re-assessment - Village to pay $1700.00 to start, $1700.00 at final physical assessment, and $3400.00 when assessment is completed - discussion ensued - Motion by Kilgus to forward a legal letter to Sheets for assessment setup and request a written response, support by Siderman - All Ayes - MOTION CARRIED

New Business:

Streetscapes Vision discussion to be held on Wednesday, September 16 from 7:00 -

 9:00 PM, Beachfront was also included - discussion ensued - Duggan stated it was only an exploratory discussion - it would be limited to streetscapes as originally planned.

Rank - Thank you note received from St. Andrews/St. Phillips for use of the Village Park , received from Jennifer Able.

Public Input:

Jim Baltazar - CLCBA events:  Fall Fest, October 3 rd - Halloween Maze, October 31 st , and Christmas Magic, December 21 st .

Al Brown - Re: Streetscapes USDA Grant money available - putting together winter sand prices.  Received a bill, hitting a manhole in the Village - ok'd by the Village to send bill to Brown - he will take care of it.

Hansen - Brookside will close on October 15 th - changed to the 11 th .

Resident - thank Brian for an excellent job - Brian stated he had a good crew.
